BULELENG – Upaya mengurai sekaligus mencari solusi terkait kegamangan perizinan pemanfaatan Air Bawah Tanah (ABT) oleh pengusaha hotel dan restoran dan izin pertambangan seperti Galian C terus dilakukan oleh Pemkab Buleleng melalui Dinas Penanaman Modal Perizinan Terpadu Satu Pintu (DPMPTSP).
Selain upaya pendampingan dan sosialisasi, melalui sinergi dengan DPMPTSP Provinsi Bali juga melaksanakan Focus Group Diskusi (FGD) melibatkan BPC PHRI Buleleng, pengusaha pertambangan/Galian C serta narasumber dari DPMPTSP dan DKESDM Provinsi Bali.
“Pemerintah daerah, dalam hal ini memfasilitasi pelaksanaan FGD untuk memberikan pemahaman sekaligus mendapatkan solusi atas permasalahan perizinan yang dihadapi rekan-rekan pengusaha hotel dan restoran serta pengusaha pertambangan, galian C di Kabupaten Buleleng,” tandas Kepala DPMPTSP Kabupaten Buleleng, Made Kuta usai membuka kegiatan di Banyualit Hotel & Spa Kawasan Pariwisata Lovina, Kamis (23/11/2023).
Kuta menegaskan, selain pemahaman tentang regulasi perizinan berbasis resiko yang diterapkan pemerintah sesuai Undang-undang Nomor 11 tahun 2021 tentang Cipta Kerja dan PP Nomor 6 tahun 2021 tentang Penyelenggaraan Perizinan di Daerah, melalui FGD ini juga diharapkan ada solusi bagi para pengusaha untuk mendapatkan izin pemanfaatan ABT dan Galian C.
“Karena pemanfaatan ABT dan usaha pertambangan/galian C masuk kategori usaha berisiko sehingga kewenangan perizinannya ada di pusat, dan kami di daerah hanya memungut namun tidak memiliki kewenangan terkait perizinan”, tandas Kuta dibenarkan Heri Wijaya. Selaku pengurus BPC PHRI Buleleng, pengusaha hotel ini menegaskan tidak ada pengusaha hotel dan restoran yang ingin melanggar aturan atau tidak melengkapi izin.
“Yang terjadi, selain persyaratan yang banyak dan cukup berat, pengurusan perijinannya juga sulit hingga ke pusat. Ironisnya, dalam proses pengurusan perizinan yang cukup lama dengan berubah-ubah kalau tidak mau disebut gamang, justru kita terjaring operasi,” ujarnya.
Operasi yang dilakukan aparat kepolisian di tengah proses pengurusan perijinan ini, kata Hery membuat para pengusaha semakin bingung dan juga resah karena tidak ada kepastian hukum.
“Yang kami butuhkan sebagai pengusaha sangat sederhana yakni kepastian hukum atas usaha yang dilaksanakan dan kami berharap melalui FGD ini ada solusi atas persoalan yang kami hadapi di Bali, karena di daerah lain seperti Banyuwangi justru perizinan bisa dikeluarkan oleh Pemprov,” tukas Heri diapresiasi Oktavianus.
Selaku narasumber, staf tenaga pendamping OSS DPMPTSP Provinsi Bali ini mengapresiasi penyampaian permasalahan terkait kegamangan perizinan yang dihadapi sebagai bahan kajian bagi DPMPTSP Bali dan DKESDM Bali yang kini menangani sektor pertambangan untuk penyempurnaan regulasi.
“Kami berharap FGD ini bisa berlanjut sehingga persoalan yang ada bisa dicarikan solusi, termasuk pemahaman terkait SKB 3 Menteri yang memberikan tenggang waktu 3 tahun bagi pengusaha untuk melengkapi perizinan dan selama proses perizinan tidak ada penindakan hukum oleh aparat penegak hukum, ini akan kami koordinasikan dengan biro hukum Pemprov Bali,” pungkasnya.
